Dispute Resolution Policy
1. Purpose
This Policy explains how disputes between users and Cars4Sure will be handled.
It is designed to:
- Resolve issues quickly
- Reduce legal costs
- Prevent unnecessary lawsuits
- Protect Cars4Sure from class actions
- Ensure fair, individual resolution
This Policy applies to all users, dealers, inspectors, vendors, and partners.
2. Agreement to Arbitration
By using the platform, you agree that any dispute, claim, or controversy between you and Cars4Sure will be resolved through binding arbitration, not in a court of law.
You waive the right to:
- A judge
- A jury
- A public lawsuit
- A class-action case
Arbitration is private and individual.
3. Right to Opt Out of Arbitration
You may opt out of the arbitration and class action waiver provisions of this Policy.
To opt out, you must send a written notice to legal@cars4sure.com within thirty (30) days of creating your account on the Platform.
Your opt-out notice must include:
- Your full legal name
- The email address associated with your account
- Your physical mailing address
- A clear statement that you wish to opt out of arbitration
If you opt out:
- Your account and access to the Platform will not be affected
- All other terms of this Policy and the Terms of Service remain in full force and effect
- You retain the right to bring claims in court, including class actions
- You will not be subject to the arbitration or class action waiver provisions of this Policy
If you do not opt out within thirty (30) days, you will be deemed to have agreed to resolve all disputes through binding arbitration as described in this Policy.
Note: This opt-out right applies only to individual consumer users. Dealers, vendors, inspectors, and other business users who have signed a separate agreement with Cars4Sure (such as the Dealer Marketplace Agreement) are bound by the dispute resolution provisions in their respective agreements and may not opt out under this Section.
4. Individual Claims Only
Disputes must be brought one-on-one.
Users may not:
- Join a class action
- Participate in mass claims
- Represent other users
- Combine claims with any other person
Each dispute must be handled individually.
5. Issues Covered by Arbitration
This Policy covers all disputes related to:
- Marketplace listings
- Dealer behavior
- Vendor behavior
- Inspections
- Missed issues
- Pricing disputes
- Platform errors or downtime
- Data accuracy
- Communication disputes
- Any contract between you and Cars4Sure
- Any service or feature on the platform
- Any claim for damages or losses
If it involves Cars4Sure or the platform, arbitration applies.
6. Issues Not Covered
Arbitration does not apply to:
- Claims Cars4Sure files against a user for fraud
- Claims related to intellectual property infringement
- Criminal activity
- Emergencies requiring court orders
Cars4Sure may choose court in these cases.
7. Informal Resolution First
Before filing for arbitration, the user must:
- Contact Cars4Sure support
- Provide a written description of the issue
- Allow 30 days for Cars4Sure to respond
Cars4Sure will attempt to resolve the issue informally. If no agreement is reached after 30 days, arbitration may proceed.
8. Arbitration Process
If arbitration is needed, it will follow these rules:
- Administered by the American Arbitration Association (AAA)
- Conducted in Pinellas County, Florida, in a simple, streamlined process
- May occur remotely
- Each party covers their own legal fees
- Cars4Sure covers required arbitration fees when required by law
The arbitrator's decision is final.
9. Location of Arbitration
Arbitration will take place in Pinellas County, Florida, unless both sides agree to a remote or online process.
Remote arbitration is allowed.
10. Governing Law
This Policy is governed by the laws of the State of Florida.
11. Time Limit to File Claims
Disputes must be filed within one year of the event that caused the claim.
Claims filed after one year will not be accepted.
12. No Class Actions
Users agree not to participate in or bring:
- Class actions
- Group lawsuits
- Collective proceedings
- Representative claims
This protects Cars4Sure from mass litigation.
13. Severability
If any part of this Policy is found invalid, the remaining parts stay in effect.
14. Survival
These dispute rules continue to apply even after:
- Account deletion
- Platform discontinuation
- User leaving the ecosystem
- Changes to Terms or Policies
15. Acceptance
By creating an account or using the platform, you confirm that you understand and accept this Dispute Resolution Policy.
If you do not accept this Policy, do not use the platform.
