1.Purpose

Cars4Sure LLC ("Cars4Sure") respects the intellectual property rights of others and expects all users of the Cars4Sure platform (the "Platform") to do the same. This Policy describes how Cars4Sure responds to claims of copyright infringement in accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512.

Cars4Sure operates as an online marketplace platform. Dealers, sellers, and other users upload content including vehicle photographs, descriptions, and other materials. Cars4Sure does not independently verify the copyright status of user-uploaded content but will respond promptly to valid takedown notices.

2.Designated Agent

Cars4Sure's designated agent for receiving DMCA takedown notices is registered with the United States Copyright Office in accordance with 17 U.S.C. § 512(c)(2):

3.Filing a DMCA Takedown Notice

If you believe that content on the Platform infringes your copyright, you may submit a written takedown notice to our Designated Agent. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works
  • Identification of the material that is claimed to be infringing and information reasonably sufficient to permit Cars4Sure to locate the material on the Platform (such as the URL of the listing or a screenshot)
  • Information reasonably sufficient to permit Cars4Sure to contact the complaining party, including name, address, telephone number, and email address
  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
Important:Notices that do not substantially comply with these requirements may not receive a response. Knowingly submitting a false or misleading DMCA takedown notice may result in liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

4.How Cars4Sure Responds to Takedown Notices

Upon receiving a valid DMCA takedown notice, Cars4Sure will take the following steps:

  • Remove or disable access to the allegedly infringing material within two (2) business days of receiving a complete and valid notice
  • Notify the user who uploaded the material (the "Respondent") that the content has been removed and provide a copy of the takedown notice
  • Inform the Respondent of their right to submit a counter-notification under Section 5 of this Policy
  • Log the takedown in Cars4Sure's internal records for repeat infringer tracking purposes

5.Counter-Notification

If you believe that material you uploaded was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our Designated Agent. Your counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, the Middle District of Florida), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person

Upon receiving a valid counter-notification, Cars4Sure will:

  • Forward the counter-notification to the original complainant
  • Inform the original complainant that the removed material will be restored in ten (10) business days unless Cars4Sure receives notice that the complainant has filed a court action seeking to restrain the Respondent from engaging in infringing activity
  • Restore the removed material between ten (10) and fourteen (14) business days after receiving the counter-notification, unless the original complainant notifies Cars4Sure of a filed court action

6.Repeat Infringer Policy

Cars4Sure maintains and enforces a policy for the termination of accounts of users who are repeat infringers. The policy operates as follows:

First Offense

The infringing content is removed. The user receives a written warning via email and through their account notifying them of the violation and this Policy.

Second Offense

The infringing content is removed. The user receives a final written warning. Cars4Sure may, at its discretion, suspend the user's ability to upload new content for a period of thirty (30) days.

Third Offense

The user's account is permanently terminated. All listings are removed from the Platform. Any outstanding fees remain due and payable. The user is prohibited from creating a new account.

Cars4Sure reserves the right to terminate any account at any time if the user engages in egregious or willful copyright infringement, regardless of the number of prior offenses.

7.Good Faith and Misrepresentation

Cars4Sure acts in good faith in processing all DMCA takedown notices and counter-notifications. Cars4Sure does not make legal determinations regarding the merits of copyright claims and relies on the representations made in the notices it receives.

Any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages under 17 U.S.C. § 512(f), including costs and attorneys' fees.

8.Modifications to This Policy

Cars4Sure may modify this Policy at any time. Changes will be posted on the Platform and will be effective upon posting. Continued use of the Platform after any modification constitutes acceptance of the updated Policy.
