1.Introduction

These Terms govern your use of the Cars4Sure platform. By accessing or using any part of the platform, you agree to follow these Terms. If you do not agree, you may not use the platform.

Cars4Sure is an automotive ecosystem. The verified marketplace is the entry into this ecosystem. The platform offers listings, inspections, maintenance tools, service connections, and future services that support your vehicle's digital identity.

2.What Cars4Sure Is

Cars4Sure is a platform that connects users with vehicles, dealers, inspectors, vendors, and other automotive service providers.

Cars4Sure does NOT:

  • Sell or buy cars
  • Repair or insure cars
  • Ship vehicles
  • Offer warranties

Cars4Sure provides digital tools, identity features, listing verification workflows, and service coordination. Cars4Sure is not responsible for the actions, conditions, or representations of third parties.

3.User Accounts

You must create an account to use the platform.

  • You agree to provide accurate and complete information
  • You are responsible for keeping your login secure
  • You are responsible for all actions taken through your account

Cars4Sure may suspend or terminate accounts that violate these Terms.

4.Communications Consent

By providing your phone number and consenting to receive text messages, you agree to the following terms regarding SMS and text message communications.

4.1Types of Messages

Cars4Sure may send the following types of text messages:

  • Transactional: Account verification codes (OTP), password resets, security alerts
  • Notifications: Listing updates, inquiry alerts, appointment reminders, service confirmations
  • Marketing: Promotional offers, new features, special deals (requires separate opt-in)

4.2Message Frequency and Costs

Message frequency varies based on your account activity. Message and data rates may apply. You are responsible for all charges from your mobile carrier. Cars4Sure is not responsible for any delays in message delivery.

4.3Opting Out

You may opt out of text messages at any time by:

  • Replying STOP to any message
  • Updating preferences in your account settings
  • Contacting support@cars4sure.com

Reply HELP for help. Note that opting out of promotional messages does not affect transactional messages related to your account security.

4.4Consent Withdrawal

Consent to receive text messages is not a condition of purchase or use of the platform. You may withdraw consent at any time without affecting your ability to use Cars4Sure, though some features requiring SMS verification may become unavailable.

5.Use of the Platform

You may use the platform only for lawful purposes. You may not:

  • Misrepresent a vehicle or upload false information
  • Abuse the messaging system
  • Harm dealers, inspectors, or users
  • Copy or reverse engineer platform functions
  • Attempt to bypass security or impersonate others

Cars4Sure reserves the right to remove content or restrict access for violations.

6.Marketplace and Listings

The marketplace displays vehicles submitted by licensed dealers and private sellers. Cars4Sure does not guarantee the accuracy of listings. All listing information is provided by the seller or dealer. Inspectors may contribute reports, but these do not guarantee long-term condition. Availability, pricing, and accuracy are the responsibility of the dealer or seller.

Buyers must perform their own due diligence.

6.1Dealer Listings

Licensed dealers must complete Cars4Sure's onboarding and verification process and execute a Dealer Marketplace Agreement before listing vehicles. Dealers are subject to the Marketplace Rules and Listing Standards, the Dealer Marketplace Agreement, and all applicable federal, state, and local laws governing motor vehicle sales, including the FTC Used Car Rule (16 CFR Part 455).

6.2Private Seller Listings

Private individuals who own a vehicle and wish to sell it may list on the Platform subject to the following conditions:

  • The seller must be the titled owner of the vehicle or legally authorized to sell it on behalf of the owner
  • The seller must provide accurate and complete information about the vehicle, including year, make, model, mileage, condition, title status, and any known defects, damage history, or liens
  • The seller must upload real, unedited photographs of the actual vehicle
  • The seller must not misrepresent the vehicle's condition, history, or legal status
  • The seller must update or remove the listing within forty-eight (48) hours if the vehicle is sold or no longer available
  • The seller is solely responsible for negotiating, documenting, and closing the sale directly with the buyer, including title transfer and payment
  • Cars4Sure is not a party to any transaction between a private seller and a buyer, does not process payments, and has no liability for the transaction
  • Private sellers who engage in a pattern of selling vehicles that suggests dealer-level activity (multiple vehicles listed in a short period) may be required to register as a dealer or have their account suspended

6.3Marketplace Rules

All dealers, sellers, and authorized agents who list vehicles on the Platform must comply with the Cars4Sure Marketplace Rules and Listing Standards, as published and amended from time to time. The Marketplace Rules are incorporated into these Terms by reference. Violations of the Marketplace Rules may result in listing removal, account suspension, or termination. By creating a dealer account or listing a vehicle, you acknowledge that you have read and agree to the Marketplace Rules.

7.Inspection Reports

Inspectors are independent contractors. They provide observations based on the time of inspection.

  • Inspections do not guarantee future condition or performance
  • Cars4Sure is not responsible for missed issues, defects, or changes after the inspection

Users agree not to hold Cars4Sure or its contractors liable for inspection outcomes.

8.Service Providers and Vendors

Mechanics, modification shops, insurance partners, import-export partners, and all other vendors are independent businesses.

  • Cars4Sure does not supervise or control their work
  • Cars4Sure is not liable for their actions, guarantees, prices, delays, or results

Any disputes must be resolved with the vendor directly.

9.Digital Vehicle Identity

The platform may create and maintain a digital identity for your vehicle. This identity includes VIN details, service information, inspection data, and other interactions on the platform.

By using the platform, you agree that:

  • Data may be stored and displayed in your profile
  • You may grant access to dealers or vendors
  • You may allow automated alerts or requests
  • You may update or request removal within legal limits

Cars4Sure does not guarantee the accuracy of third party data.

10.Payments and Fees

Certain services may include fees, such as:

  • Listing fees and lead fees
  • Inspection fees
  • Vendor services
  • Future subscriptions

All fees are non-refundable unless stated otherwise. Cars4Sure is not responsible for financial agreements between users and vendors.

11.Intellectual Property

Cars4Sure owns all rights to:

  • Brand, logo, and platform design
  • Workflows and digital identity system
  • Inspection processes and data structures
  • Software code and documentation

You may not use these without written permission.

Copyright Complaints

For copyright claims, see our DMCA Copyright Policy. Cars4Sure maintains a repeat infringer policy and may terminate accounts of users who repeatedly infringe copyrights.

12.Disclaimers

The platform is provided "as is" and "as available." Cars4Sure makes no guarantees about:

  • Accuracy of listings or inspection outcomes
  • Performance of vehicles or actions of dealers
  • Vendor services or uptime of the platform
  • Future service availability
Use the platform at your own risk.

13.Limitation of Liability

To the maximum extent permitted by applicable law, Cars4Sure shall not be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, revenue, goodwill, use, data, or other intangible losses, arising out of or relating to your use of or inability to use the platform, regardless of whether such damages are based on contract, tort, strict liability, or any other legal theory, and even if Cars4Sure has been advised of the possibility of such damages.

This limitation applies to all claims arising from or related to: inaccurate listings; mechanical failures or vehicle condition issues; misrepresentations by dealers, sellers, or vendors; missed inspection issues; errors by service providers; platform outages, delays, or data errors; and unauthorized access to your account.

Cars4Sure's total aggregate liability arising out of or relating to your use of the platform or these terms shall not exceed the greater of (a) the total amount of fees paid by you to Cars4Sure during the twelve (12) months immediately preceding the event giving rise to the liability, or (b) one hundred dollars ($100).

Cars4Sure is a marketplace platform and is not a party to any transaction between users. Cars4Sure shall have no liability for any dispute, claim, or damage arising from any transaction between a buyer and a dealer, seller, inspector, or vendor.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, Cars4Sure's liability shall be limited to the fullest extent permitted by law.

14.Dispute Resolution

All disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Pinellas County, Florida. No class actions are allowed. Claims must be made individually.

You may opt out of arbitration by sending written notice to legal@cars4sure.com within thirty (30) days of creating your account. See the full Dispute Resolution Policy for complete terms, procedures, and opt-out details.

Dealers and other business users with signed agreements are governed by the dispute provisions in those agreements.

15.Termination

Cars4Sure may suspend or terminate accounts for violations of these Terms or unsafe behavior. Users may stop using the platform at any time.

16.Changes to These Terms

Cars4Sure may update these Terms. Users will be notified when changes occur. Continued use of the platform means acceptance of the new Terms.
